This End-User License Agreement is a legal agreement between you (either an individual or a single entity, referred to as licensee) and Lupinho.NET (referred to as licensor) for the HardlinkBackup software product which may include associated software components, media, printed materials, and “online” or electronic documentation (hereinafter referred to as HardlinkBackup). By installing, copying, or otherwise using HardlinkBackup, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use HardlinkBackup. HardlinkBackup is protected by copyright laws, as well as other intellectual property laws and treaties. HardlinkBackup is licensed, not sold.

Licenses

A license for a registered version will never expire. You can receive updates and bug fixes for the purchased version for free. You will receive a license key which is necessary to enable the registered editions of the software. This key must be kept in the strictest confidence and must not be given or revealed to anyone but the registered owner.

• Community License / Unregistered edition: HardlinkBackup is free for private use.

• Professional License: The Professional License of HardlinkBackup may either be used by a single person who uses the software personally on one computer, or installed on a single computer used by multiple people. To use HardlinkBackup on additional computers, another Professional License will be needed per computer.

• Enterprise License: The Enterprise license can be used commercially. One Enterprise License of HardlinkBackup may either be used by a single person who uses the software personally on one computer, or installed on a single computer used by multiple people. To use HardlinkBackup on additional computers, another Enterprise License will be needed per computer.

Other Rights and Limitations

You may not

• permit other individuals to use HardlinkBackup except under the terms listed above
• distribute registered versions. You are allowed to distribute the unregistered version
• modify, translate, reverse engineer, decompile, or disassemble HardlinkBackup
• create derivative works based on HardlinkBackup
• rent, lease, transfer or otherwise transfer rights to HardlinkBackup
• remove any proprietary notices or labels on HardlinkBackup
• use HardlinkBackup for any illegal purposes

No warranties

The licensor expressly disclaims any warranty for HardlinkBackup. HardlinkBackup is provided ‘As Is’ without any express or implied warranty of any kind, including but not limited to any warranties of merchantability, non-infringement, or fitness of a particular purpose. The licensor does not warrant or assume responsibility for the accuracy or completeness of any information, text, graphics, links or other items contained within HardlinkBackup. The licensor makes no warranties respecting any harm that may be caused by the transmission of a computer virus, worm, time bomb, logic bomb, or other such computer program. The licensor further expressly disclaims any warranty or representation to Authorized Users or to any third party.

Limitation of Liability

In no event shall the licensor be liable for any damages (including, without limitation, lost profits, business interruption or lost information) rising out of ‘Authorized Users’ use of or inability to use HardlinkBackup, even if the licensor has been advised of the possibility of such damages. In no event will the licensor be liable for loss of data or for indirect, special, incidental, consequential (including lost profit), or other damages based in contract, tort or otherwise. The licensor shall have no liability with respect to the content of the software product or any part thereof, including but not limited to errors or omissions contained therein, libel, infringements of rights of publicity, privacy, trademark rights, business interruption, personal injury, loss of privacy, moral rights or the disclosure of confidential information.

Termination

The license will terminate automatically if you fail to comply with the limitations described above. On termination, you must destroy all copies of HardlinkBackup.
